SERVICE

All purchases or rentals must be made in writing and accompanied by a deposit check, after validation, subject to availability and unless otherwise agreed. This deposit is calculated based on the items rented.

GENERAL CONDITIONS OF USE BUYERS

2. PREAMBLE

PASSION DECOR invites its users to carefully read these T&Cs.

PASSION DECOR offers a market place on www.passiondecor.net , allowing major and professional sellers to enter into contact with private or professional buyers, with the aim of selling new and second-hand products at fixed prices. Sales made through the Marketplace between buyers and sellers are governed by the General Terms and Conditions of Sale, which must be accepted by the Seller upon registration.

PASSION DECOR reserves the right to modify these T&Cs with immediate effect for the Products online as soon as they are notified to the Seller.

3. DEFINITIONS

Buyer: Refers to any type of natural or legal person who places an order on the PASSION DECOR site

Order: Refers to any order placed by the user registered on this site, with a view to benefiting from the services of PASSION DECOR

General conditions of sale and of use (or / CGV / CGU): refer to these general conditions of sale and online use

Marketplace: Refers to the intermediary between the buyer and the seller, i.e. the company PASSION DECOR 

Services : Refers to all the services offered to users by PASSIONDECOR through this site

Site: Refers to this site, i.e. https://www.passiondecor.net

Company: Refers to the company PASSION DECOR, more fully designated in article 1

User: Refers to all persons using the PASSION DECOR site 

Seller: Refers to any type of person who has a supplier account on PASSION DECOR and who is authorized to sell on our internet 

4. A ACCESS TO THE SITE

Access to the site by Buyers is free and is reserved for all legal or natural persons of legal age and enjoying their full personality and legal capacity.

It is subject to acceptance of these Buyer T&Cs when opening an account on the site.

To proceed with the registration, the buyer must fill in all the mandatory fields, without which the service cannot be delivered.        

You agree to provide only accurate information and to inform PASSION DECOR without delay of any change affecting them by sending a simple email to [email protected].

Every registered user has a login ID and a password. These funds are strictly personal and confidential. You also agree not to disclose to any third party. You will be solely responsible for access to the site via your username and password unless there is proof of fraudulent use which is not attributable to you.

In the event of loss, misappropriation or fraudulent use of your username and/or password, you agree to immediately notify PASSION DECOR so that we can take the necessary measures and regularize the situation by email to [email protected] clean.

Each buyer, whether a natural or legal person, can only hold one account. The deletion of an account leads to the permanent loss of all the advantages and services acquired on the site and the prohibition to re-register on our site.

5. DESCRIPTION OF THE SITE

The site is made up of technological tools allowing buyers to get in touch with the seller in order to place orders for products and to pay the price of said products.

The site also incorporates a seller rating system.

Transactions carried out via the site for the purchase of products are concluded directly between the buyer and the seller.

PASSION DECOR is in no way a reseller of the products offered by the seller through the Marketplace.

Products purchased may be taken back or exchanged by PASSION DECOR.

However, complaints can be brought to the attention of PASSION DECOR by email to the address [email protected].

In the event of non-compliance with these general conditions of use for the buyer, PASSION DECOR reserves the right to temporarily or permanently interrupt access to the Marketplace for the buyer concerned and to take legal action against him.

Each buyer agrees to make purchases in good faith.

6. PRICE OF THE SERVICE

Opening an account and using the site are free (excluding any connection costs, the prices of which depend on your electronic communication operator) with no obligation to purchase on the site. Only the purchase of products from sellers is chargeable (see conditions provided for in the GCS).

7. ORDER

Any order can be placed on the condition of having created an account beforehand. Once the order has been placed, the customer will automatically receive a confirmation by email.

In the event of non-payment, incorrect customer address or other problems on the customer account, PASSION DECOR reserves the right to block the customer's order until the problem is resolved.

If the service cannot be carried out, the buyer will be informed by email to the address he has provided. The cancellation of the order will then be made within 1 month.

Any complaint must be made by email via the customer account interface. No claim can be made by telephone

The buyer agrees to non-disclosure of personal information during his exchanges with the seller (email etc.). Otherwise, legal action may be taken against the person in question.

8. DEADLINES AND TERMS OF PAYMENT 

Unless otherwise indicated, all sales concluded between a buyer and a seller are payable in cash.

Payment can be made by bank transfer or credit card.

9. PERSONAL DATA 

The data communicated by the user within the framework of an order (last name, date of birth, address, telephone, etc.) via the site are intended for PASSION DECOR and are used for the treatment and the follow-up some orders.

The information and data concerning you are processed by PASSION DECOR. The information necessary for the delivery will be transferred to the seller for this sole purpose.

This information and data is also kept for security purposes, to comply with the legal and regulatory obligations incumbent on PASSION DECOR in order to improve and personalize the services we offer you.

Moreover, in accordance with the "Data Protection Act" of January 6, 1978, the user has the right to rectify and delete personal data.

To do this, simply write to us online at Customer Service or by mail to PASSION DECOR parc de la Croisée 209/217 Avenue de la République 93800 Epinay-sur-Seine indicating your name, first name, email, and customer number. .

In accordance with the regulations in force, your request must be signed and accompanied by a photocopy of your identity document bearing your signature. Please specify the address to which we should send you the reply.

A response will then be sent to you within a maximum period of 2 months following receipt of the request.

If any of this information is missing, PASSION DECOR reserves the right to refuse your request.

SHIPPING AND RETURNS SHIPPING

OF PACKAGES

Packages are generally shipped within 2 days of receipt of payment. They are shipped via GLS, DPD, or any other carrier with a tracking number and delivered against signature. You can choose this delivery method because it incurs additional costs. Whatever delivery method you choose, we send you a link to track your package online.

Delivery is free from 99€ of purchases for all products that are shipped via our carrier GLS. 

All other carriers are billed based on the weight and quantity of items ordered.

As for fragile products, they are shipped via Geodis Calberson, the conditions of which are mentioned below:

Reservations at the time of delivery must be precise and complete as to the nature of the damage visible on the packaging and the condition of the merchandise.

The anomaly noted must be clearly written and relate mainly to the goods and not exclusively to the packaging. Reservations must be written on the delivery receipt in front of the driver, who is entitled to issue counter reservations. It is in your interest to accept the goods, if the driver opposes your right of reservation.

It is imperative to check all products upon receipt 

"Subject to unpacking control" is not a valid reservation

Shipping costs include preparation and packaging costs as well as postage. The preparation costs are fixed, while the transport costs vary according to the total weight of the package. We recommend that you consolidate all of your items into one order. We cannot combine two orders placed separately and shipping charges apply to each of them. Your package is shipped at your own risk, but special attention is paid to fragile items.

 

Box sizes are appropriate and your items are properly protected.

RETURN OF PACKAGES

Returns of products shipped via DPD are free of charge. To do this, the customer must log on to his customer account and follow the procedure indicated to print the return label and drop off the package at the Sun relay point near his home. 

Returns via GLS are also free. To do this, simply send an email to [email protected] and notify your request. 

Returns of fragile products sent via Géodis are chargeable. However, in the event that the item is defective, broken or missing, we will take responsibility for the exchange of the product. 

Any complaint and/or return must be made by email to the following address [email protected] within 30 days of the date of receipt of the order. Any request after this date will not be taken into account by our services.

Passion Décor does not offer refunds.

Any return or cancellation is offset by a credit note.

For international shipments if a product is not suitable, the return costs are the responsibility of the customer.

This return must imperatively be done within 30 days to the following address passion decor 209 avenue de la République 93800 Epinay sur Seine. After this period, no complaint can be taken into account.

In the event of a return, Passion Decor will only reimburse the returned material.

Under no circumstances will customs fees, VAT or other costs generated by the customer be refunded.

This credit note is exceptionally valid for one year

CONDITIONS

Passion Décor remains the legal owner of the rented equipment.

Passion Décor disclaims all liability in the event of direct or indirect damage occurring during the use of the rented equipment.

Any reservation is made exclusively by the delivery of the signed quote duly accepted and by the payment of the deposit. In the event of cancellation of the rental by the customer, any deposit paid for the reservation of the equipment will not be refunded after the withdrawal period of 7 days provided for by law.

A late penalty of 15% of the total amount of the rental will be applied for each day of delay following the date mentioned.

Any total deterioration or missing item generates additional costs for the customer. These replacement costs correspond to the sale price indicated on our site.

Any complaint concerning missing or defective equipment must reach us no later than the day of receipt.

Passed the date of the reception no complaint will be accepted. No refunds will be made for unused rented equipment.

For any cancellation made one week after the signature of the quote, the deposit paid will be refunded. Beyond that, it will be kept and non-refundable.

TRANSPORT

The rate will be applied for delivery and collection according to the current scale set up by PASSION DÉCOR. Any handling not provided for in the initial quote and any waiting time will be subject to additional invoicing.

When sending the equipment, if the recipient notices a claim upon receipt of the package, he must immediately formulate the legal reservations with the carrier and inform Passion Décor.

PROVISION OF RENTED EQUIPMENT

The ordering customer must be present when the rented equipment is delivered and returned. He acknowledges receiving the equipment in good condition, suitable for operation and in compliance with the health and safety standards in force. A contradictory inventory will be made when the rented equipment is made available ON REQUEST BY THE CLIENT ONLY and when the rented equipment is returned. The ordering customer is required to attend in order to sign this inventory. The materials returned must be sorted, stored and returned in the delivery packaging, failing which the contradictory inventory would be carried out in our warehouse. In the absence of a signature, no dispute will be accepted and only the lessor's inventory will prevail. The equipment will only be considered as returned after having been the subject of a contradictory inventory or, in the event of refusal by the ordering customer, of an inventory on the part of the lessor alone. Upon removal of the equipment, the customer must submit a deposit check equivalent to the replacement value of the rented products. If a problem occurs with the products, the customer will be required to pay for the defective or lost equipment up to the amount of the damage suffered. The deposit check is then delivered or sent to the customer.

USE/REPAIR/NON-RETURN

The ordering customer undertakes to use the rented equipment in accordance with its usual destination and to do nothing or allow it to be damaged. In particular, it will provide the necessary electrical installation with power, in accordance with the regulations in force. The instructing customer certifies that he is able to use the rented equipment, either himself or through duly qualified authorized persons. No modification or transformation may be made to the rented equipment. Throughout the duration of the provision, the ordering customer is required to ensure the maintenance of the rented equipment and to protect it against any damage: vandalism, overload, bad weather, wind, rain, snow, frost, etc. The ordering customer is not entitled to any compensation in the event of interruption of operation of the rented equipment. Missing or broken equipment will be invoiced to the ordering customer at the current replacement rate.

PAYMENT

All invoices are payable in cash, upon receipt for account companies, on order for other customers. It is agreed that failure to pay on the due date will result in: - a late payment penalty calculated at 3 times the legal interest rate, from the due date and on all amounts remaining due; - litigation costs; - the payment, as a penalty clause, of an indemnity equal to 15% of the sums due, as well as legal costs. No discount will be granted in the event of early payment. For any claim, the customer has a maximum period of one month from the date of invoicing. No complaint received more than one month after the invoice date can be taken into account.

RETENTION OF OWNERSHIP

The leased equipment remains the entire property of the lessor and the lessee agrees not to allow it to be seized by one of his creditors. The equipment sold remains the sole property of the seller until full payment of the price, principal and interest, in application of Law 80-335 of May 12, 1980. However, the transfer of risks takes place upon delivery.

FORCE MAJEURE

The renter cannot be held responsible for delays or non-deliveries due to force majeure or any reason beyond his control, such as, but not limited to, strikes, bad weather, accidents, official bans, etc.

RESPONSIBILITY AND INSURANCE

Responsibility and material and legal custody of the rented equipment are transferred when they are made available. The instructing client assumes this custody under his full and sole responsibility. He will take out an insurance contract at his own expense to guarantee his liability during the time he has custody of the facilities and equipment rented. The ordering client, as organizer of the event during which the lessor or the service provider is involved, must in particular take care of obtaining all the authorizations necessary for the services ordered, ensuring that the premises are available and accessible without difficulty of any kind, and obtain from its insurance companies any extensions of guarantees. No complaint from the ordering customer will be admissible beyond a period of 24 hours after the service provided by the lessor. No compensation may be claimed from the lessor for loss of use or any commercial disturbance, whatever the cause or origin.

JURISDICTION

In case of dispute, the Court of the seat of the seller will have sole jurisdiction.
